This may include the technical and usage details described in Section 2(D) and 2(E).

C. From Service Providers and Partners

We may receive limited personal information from:

  • Shopify, which powers our online store, checkout, and customer accounts
  • Payment processors, regarding payment status and fraud checks
  • Shipping carriers (e.g., Canada Post, Purolator, FedEx, UPS), regarding delivery status and tracking
  • Analytics tools (e.g., GA4, Hotjar) and advertising tools (e.g., Meta Pixel), in aggregated or pseudonymous form

When Shopify processes information about you on our behalf, they do so in accordance with their own privacy policy and data-handling practices in addition to ours.

4. Cookies and Similar Online Tracking Technologies

We and our third-party partners use cookies, pixels, and similar technologies (“tracking technologies”) on the Site for several purposes, including:

  • Essential site functionality (e.g., shopping cart, checkout, login, security)
  • Analytics and performance (e.g., GA4, Hotjar)
  • Marketing and advertising (e.g., Meta Pixel for retargeting)

A. Categories of Cookies and Tracking Technologies

  • Strictly Necessary Cookies
    • Required for the Site to function (e.g., keeping items in your cart, processing checkout, maintaining security).
    • These are generally exempt from consent under many privacy laws.
  • Analytics and Performance Cookies
    • Provided by tools such as Google Analytics (GA4) and Hotjar.
    • Help us understand how visitors use the Site, which pages are most popular, session durations, and how users navigate and interact.
  • Advertising and Social Media Cookies
    • Used by platforms such as Meta (Facebook/Instagram) and other advertising partners.
    • Enable remarketing/retargeting and measure ad performance.
    • Under U.S. state laws like the CPRA, these activities may be considered a “sale” or “sharing” of personal information for cross-context behavioral advertising.

B. Cookie Consent and Controls

  • In Canada (including Québec), we use or intend to use a cookie consent banner / preference center to obtain meaningful consent for non-essential cookies (analytics, advertising), and to allow you to accept or decline these categories.
  • In the United States, you may manage your preferences for advertising and analytics cookies via:
    • Browser settings
    • “Do Not Sell or Share My Personal Information” / “Your Privacy Choices” link (where implemented)
    • Opt-out mechanisms offered by specific providers (e.g., Google Analytics opt-out browser add-on).

Please note that disabling certain cookies may limit your ability to use some features of the Site (for example, keeping items in your cart).

5. How We Use Your Personal Information

We use the personal information we collect for a variety of business and operational purposes.

A. Providing Products and Services

We use your personal information to provide, operate, and maintain our products and services. This includes processing and fulfilling your orders, managing shipping, returns, and refunds, and enabling you to create, access, and maintain your customer account. We also use your information to display your order history and account details, to remember your preferences (such as currency or delivery country), and to operate, maintain, and improve the core functionality of the Site.

B. Communicating With You

We use your personal information to communicate with you in connection with your interactions and transactions with us. For example, we send order confirmations, shipping updates, and other transactional or service-related messages. We also respond to your inquiries, requests, and support needs, and may contact you to inform you about important changes to our terms, policies, or the Site itself.

C. Marketing and Promotional Purposes

With your consent where required by law, we use your personal information for marketing and promotional purposes. This may include sending you promotional emails and newsletters that you have expressly opted in to receive, informing you about new products, special offers, or other updates we think may be of interest to you. We may also use certain information to show you interest-based or retargeted advertisements on third-party platforms (for example, through Meta Pixel) and to measure the effectiveness and performance of our marketing campaigns. You may opt out of marketing communications at any time as described in Section 8.

D. Analytics and Personalization

We use personal information, including information collected automatically through cookies and similar technologies, to better understand how visitors use our Site, how our pages perform, and how customers interact with our content and products. This helps us analyze and improve the layout, design, content, and navigation of the Site. We may also use this information to personalize your experience, for example, by showing products or content that are more relevant to your interests or past interactions with us, or by remembering your language, region, or display preferences.

E. Security and Fraud Prevention

We use personal information as necessary to protect the security and integrity of our business, the Site, and our customers. This includes detecting, investigating, and preventing fraud, abuse, unauthorized transactions, and other malicious or unlawful activities, as well as safeguarding our systems and networks against security incidents.

F. Legal and Compliance

We may use your personal information to comply with applicable legal, regulatory, tax, and accounting obligations, and to maintain appropriate business records. We also use personal information to respond to lawful requests from public authorities, regulators, or law enforcement, where required, and to establish, exercise, or defend legal claims. In addition, we may use information to enforce our Terms of Use, other applicable agreements, and to protect our rights, property, and the rights and safety of our customers and others.

6. How We Disclose Your Personal Information

We do not sell personal information in the traditional sense (for money). We disclose personal information in the following ways:

A. Service Providers

We share personal information with service providers who perform services on our behalf, such as:

  • Shopify (store platform, hosting, checkout, payment integrations)
  • Payment processors
  • Shipping and logistics providers (e.g., Canada Post, Purolator, FedEx, UPS)
  • Analytics providers (e.g., Google Analytics, Hotjar)
  • Advertising and social media platforms (e.g., Meta Pixel)

These service providers are allowed to use your personal information only as needed to provide services to us and are expected to protect it appropriately.

B. Targeted Advertising and “Sharing” Under U.S. Law

When we use tools like Meta Pixel or similar technologies, we may disclose identifiers, device data, or browsing activity to advertising partners so they can help us show you relevant ads on their platforms. Under some U.S. state laws (such as California’s CPRA), this may be considered “sharing” personal information for cross-context behavioral advertising.

You can opt out of this “sharing” (see Section 8 and Section 14).

C. Legal and Safety

We may disclose personal information:

  • To comply with legal obligations, court orders, or lawful requests
  • To protect the rights, property, or safety of Stalberry, our customers, or others
  • To detect, investigate, and prevent fraud, security incidents, or misuse of the Site

D. Business Transfers

If we are involved in a merger, acquisition, restructuring, or sale of some or all of our assets, your personal information may be transferred as part of that transaction. Any successor entity would be required to handle your personal information in a manner consistent with this Privacy Policy or as otherwise required by law.

E. With Your Consent

We may disclose your information to other third parties when you explicitly ask or consent for us to do so.

7. How We Protect Your Personal Information

We use reasonable technical and organizational measures designed to protect personal information from unauthorized access, use, loss, or disclosure, including:

  • Encryption in transit (HTTPS/TLS) for the Site
  • Access controls and authentication for administrative accounts
  • Limiting access to personal information to those personnel and service providers who need it
  • Working with Shopify’s secure infrastructure and certifications

However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

We encourage you to:

  • Use a strong, unique password for your account
  • Log out of your account on shared devices
  • Contact us promptly if you suspect unauthorized access to your account

8. Your Rights and Choices

Your privacy rights depend on where you live, but we aim to offer a consistent baseline of control.

A. Access, Correction, and Deletion

Subject to applicable law, you may have the right to:

  • Request access to the personal information we hold about you
  • Request correction of inaccurate or incomplete information
  • Request deletion of your personal information (subject to legal and operational retention requirements)

You can often update basic account and contact information directly by logging into your account on stalberry.com. You can also email us at hello@stalberry.com for assistance.

B. Marketing Communications

You can opt out of marketing emails by:

  • Clicking the “unsubscribe” link in any marketing email, or
  • Contacting us at hello@stalberry.com

Even if you opt out of marketing, we may still send you transactional or service-related communications (e.g., order confirmations, shipping notifications, important account notices).

C. Cookies and Online Tracking

You can manage cookies and tracking technologies by:

  • Using our cookie banner / consent management tools (where implemented)
  • Adjusting your browser settings to block or delete cookies
  • Using provider-specific opt-outs (e.g., Google Analytics browser add-on)

Note: Blocking cookies may affect the functionality of the Site.

D. “Do Not Sell or Share” and Targeted Advertising

For U.S. residents in certain states (including California):

  • We treat our use of advertising and analytics tools that involve cross-context behavioral advertising as “sharing” under applicable law.
  • Where required, we will provide a “Do Not Sell or Share My Personal Information” or “Your Privacy Choices” link on our Site.
  • You can use that link to opt out of our “sharing” of your personal information for targeted advertising.

9. International Transfers and Where Your Information Is Processed

We are based in Canada, and our online store is hosted on Shopify, which operates data centers and infrastructure in multiple regions, including Canada, the United States, and other locations, to provide a fast and reliable service.

As a result, your personal information may be transferred to and processed in countries outside of your place of residence. In some of these countries, privacy and data protection laws may be different or less protective than those in your jurisdiction.

Where required by law, we implement appropriate safeguards for these transfers, such as contractual protections and technical measures, and we rely on Shopify’s data protection framework for processing on our behalf.

10. Data Retention

We retain personal information for as long as reasonably necessary to:

  • Provide the Site and our products and services
  • Fulfill your orders and maintain your account
  • Comply with legal, tax, and accounting obligations
  • Resolve disputes and enforce our agreements

As a general guideline:

  • Customer account and profile information is retained while your account is active and for up to seven (7) years after your last interaction or as otherwise required by law.
  • Order and transaction records are typically retained for at least seven (7) years to meet tax and legal requirements.

Because we operate on Shopify, certain data may also be retained for the lifetime of the store, with personal data purged a period of time (for example, around two years) after a store becomes inactive, while some non-personal transactional data may be retained longer.

We may retain data for longer where required or permitted by law, or for legitimate business purposes such as fraud prevention.

11. Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. To learn more about how Shopify uses your personal information and any rights you may have, you can visit the Shopify Consumer Privacy Policy . Depending on where you live, you may exercise certain rights with respect to your personal information here Shopify Privacy Portal Link.

12. Children’s Privacy

Our Site and products are intended for general consumers and are not directed to children under the age of 13.

We do not knowingly collect personal information directly from children under 13. If we learn that we have collected personal information from a child under 13 without appropriate consent, we will take reasonable steps to delete that information. If you believe that a child has provided us with personal information, please contact us at hello@stalberry.com.

If additional requirements apply in your state or province regarding minors’ data, we will comply with those requirements.

13. Complaints

If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you live, you may have the right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority.

15. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal requirements.

When we make changes, we will:

  • Update the “Last updated and effective date” at the top of this page, and
  • Post the revised Privacy Policy on the Site

In some cases, we may provide additional notice (such as by email or a prominent notice on the Site) if changes materially affect your privacy rights.

Your continued use of the Site after the updated Policy becomes effective means you agree to the revised Policy.

16. Additional Information for Certain U.S. State Residents

  • Right to know what categories of personal information we collect and how we use them

We will provide one or more of the following mechanisms (depending on your jurisdiction and Site implementation):

  • A “Do Not Sell or Share My Personal Information” or “Your Privacy Choices” link in the Site footer
  • A web form to submit access, deletion, and correction requests
  • Instructions for exercising rights via email

We may need to verify your identity before fulfilling certain requests, which can include confirming information associated with your account or recent orders. Where allowed, you may designate an authorized agent to make requests on your behalf, subject to verification and applicable legal requirements.

17. Notice About Loyalty Programs and Financial Incentives

From time to time, we may offer promotions, referral codes, discounts, or other benefits that involve the collection and use of personal information (for example, email sign-up discounts or promotional campaigns).

If any such program qualifies as a “financial incentive” or bona fide loyalty program under applicable law, we will provide a separate disclosure describing:

  • The material terms of the program
  • Categories of personal information collected
  • How to join and how to withdraw from the program
  • How the value of the program is reasonably related to the value of your personal information

At this time, Stalberry does not operate a formal loyalty program that meets those thresholds. If this changes, we will update this section and/or provide an additional notice.
